1.1 The property is let to you for holiday letting purposes only for the period stated in the confirmation message. Not for commercial purposes unless specifically agreed in writing.
1.2 No functions, parties, weddings, group gatherings, photoshoots, or commercial activities of any kind unless prior arrangements have been made. Permission is at the agent's sole discretion, and a surcharge might apply.
1.3 The name under which the booking is made must stay at the property, and they are held responsible for the actions of the group and are accountable for every individual staying at the property. They are responsible for ensuring that all occupants understand and agree to these terms and conditions. Neither the whole nor any part of the property shall be sublet without permission.
1.4 You agree to supply us with the number of all adults and children staying or visiting, plus the ages of all children. Guests aged between 12 months and 17 years are classified as children. Guests under 12 months are classified as infants.
1.5 At no time during your occupancy will the number of guests staying or visiting exceed the number you gave at the time of booking. There are no exceptions except with written permission from Pointer Property.
1.6 If consent for extra people is not given by the agent, immediate eviction will follow with no refund given, or at our discretion, you may be charged for any additional guest found to have been at the property during your stay at $500.00 per person per day for the time of the booking.
1.7 The property is located in a quiet rural neighbourhood. The Guest is asked to respect this and ensure that all guests and visitors behave appropriately.
1.8 A quiet period applies from 11:00 pm until 7:00 am. The Guest is responsible for the behaviour of the guests staying at the property and visitors to the property during the Rental Period.
1.9 Illegal activities, including gambling, prohibited drugs, possession or use of pyrotechnics or dangerous goods, and possession or use of firearms and other weapons, are strictly prohibited.
1.10 Should any guest or visitor not behave appropriately, the Owner or Owner's Representative may, in their absolute discretion, require the Guest, their party and/or visitors to leave the premises and vacate the Property immediately, without compensation or refund.
1.11 The appropriate ID of the booker must be provided on request so that a copy may be taken for our security. Acceptable ID is a passport or driver's licence.

16. POOL SAFETY

16.2 An adult must accompany children under 14 years at all times.
16.3 There is strictly no diving, and no glass in or near the pool.
16.4 Our gardening and pool staff may require access to the gardens and pool area during your stay. We keep these visits to a minimum, but they are sometimes unavoidable to maintain the property. Where maintenance needs to enter the property, we will give you as much notice as possible.
17. BBQ
17.1 Guests are not permitted to bring their own BBQ or outdoor cooking equipment to Ocean Farm. Guests are welcome to use the equipment supplied.
17.2 The BBQ must not be moved from the western side of the courtyard, as moving it can cause damage to the BBQ and its surrounds.
18. PRIVACY
18.1 To take and manage your booking we collect your name, contact details, billing address, payment card details, the names and ages of others in your party, arrival and departure information, a copy of photographic identification where required under clause 1.11, and any correspondence between us.
18.2 We use this information to process and manage your reservation, take payment and any charges permitted under these terms, communicate with you before, during and after your stay, meet our legal, tax and accounting obligations, and resolve disputes.
18.3 Card details are collected and stored by our booking and payment providers. We do not store full card numbers ourselves.
18.4 We share your information with our property management, cleaning and maintenance providers to the extent needed to service your stay; with our booking system, payment processor and communication providers; with our accountants and professional advisers; and where required by law.
18.5 A single external security camera is fitted at the property. It monitors the driveway and vehicle approach only. It does not record audio, and it does not cover any interior space, the pool area, or any other area where guests would reasonably expect privacy. Footage is retained for seven days and is accessed only where there is a security or damage incident. No other cameras, listening devices or monitoring equipment are in use at the property.
18.6 We keep booking and financial records for as long as required for tax and accounting purposes and for the period in which a claim could be brought, and then delete or anonymise them.
18.7 You may request access to, or correction of, the personal information we hold about you. Guests resident in the European Union or United Kingdom have additional rights under the General Data Protection Regulation, including rights of erasure and data portability. To make a request, or to make a complaint about how we have handled your personal information, contact us at stay@oceanfarm.com.au
18.8 We take reasonable steps to protect your information. If an eligible data breach occurs, we will notify affected individuals and the Office of the Australian Information Commissioner as required under the Notifiable Data Breaches scheme in Part IIIC of the Privacy Act 1988 (Cth).
19. FORCE MAJEURE
19.1 Neither party is liable for failure or delay in performing its obligations under this agreement where that failure or delay is caused by an event beyond its reasonable control.
19.2 Such events include, without limitation: bushfire, flood, storm, cyclone, extreme heat or other severe weather; loss of or restricted access to the property or the roads serving it; loss of utilities including power, water or internet; epidemic, pandemic, or government orders restricting travel or occupancy; acts of war, terrorism or civil disturbance; airport or airline disruption; and strikes or industrial action.
19.3 If such an event prevents the stay from proceeding, we will contact you as soon as reasonably practicable and offer, at your election, a credit for a future stay of equivalent value valid for 12 months, alternative dates subject to availability, or a refund of amounts paid less any costs we have already irrecoverably incurred.
19.4 We are not liable for any consequential loss arising from such an event, including travel costs, flights, or other bookings made in connection with your stay. Guests are strongly advised to hold travel insurance covering cancellation and interruption.
19.5 Where the event affects your ability to travel rather than our ability to provide the property, the cancellation terms of your booking apply.
20. CONSUMER GUARANTEES
20.1 Nothing in these terms excludes, restricts or modifies any guarantee, right or remedy you have under the Australian Consumer Law that cannot lawfully be excluded, restricted or modified. Where our liability can be limited, it is limited to resupplying the accommodation or paying the cost of resupply.
21. GOVERNING LAW
21.1 These terms are governed by the laws of New South Wales, Australia. You and Pointer Property Pty Ltd submit to the non-exclusive jurisdiction of the courts of New South Wales and the courts competent to hear appeals from them.
21.2 If a dispute arises, you agree to contact us first at stay@oceanfarm.com.au and allow us a reasonable opportunity to resolve it. We will acknowledge your complaint within five business days and respond substantively within twenty business days.
21.3 Nothing in this section prevents either party from seeking urgent interlocutory relief, or limits your right to make a complaint to a regulator or to pursue a remedy available under the Australian Consumer Law.
